MANILA, Philippines -- The criminal complaint filed by a former housemaid against the brother of tycoon Lucio Tan, Mariano Tanenglian, is meant to harass him for offering to testify against his sibling, Tanenglian's lawyer told the Inquirer on Thursday.

"The charges are part of a bigger picture and meant to discredit my client for volunteering to testify against his brother Lucio, over a government case,'' lawyer Raymundo Quiroz said in a
telephone interview.

Quiroz explained that the case against his client and his family started to surface after Tanenglian communicated with the PCGG and the Office of the Solicitor General and offered to testify against Lucio Tan.

He said the letter was submitted to the two offices on July 18, 2009.

"Someone bigger, powerful and influential is behind the charges, because how can a maid
who already signed a quit claim and received money would continue to mount a case?'' the lawyer said.

He said his client was asking for immunity from suit in exchange for his testimony against his brother.

"We sent our press statement to the media offices, including the PCIJ, but nothing has come out. We know that Lucio has the power to pull out advertisements,'' he said.
He also denied reports that Mary Jane Sollano, the maid who accused his clients of maltreatment, serious illegal detention, slavery and frustrated homicide was not rescued by the police.

"The maid was not rescued by the police, but was turned over by my client to the father and uncle in the presence of the barangay leader,'' Quiroz said.

He added that he had yet to see the complaints filed at the Department of Justice against his client by Sollano.

Housemaid files case vs Lucio Tan’s brother

MANILA, Philippines—An 18-year-old housemaid filed a criminal case against her former employer, the brother of business tycoon Lucio Tan.

Mary Jane Sollano filed the case before the Justice department for maltreatment, illegal detention, slavery and frustrated homicide against Mariano Tan, his wife Aleta and children Maximilian and Fayette.

In her three-page affidavit, the victim detailed the “physical and mental abuses” she suffered in the hands of the Tan family in their Quezon City residence from July 2004 up to August 10.

Sollano said she and the other house help were “not allowed to use the telephone or cell phone, talk to fellow house helpers, laugh, sit in their (family's) chairs, look
outside the window, watch TV, eat at any time, sleep or rest before our tasks were completed, and read any material or write.”

She also claimed that Tan’s wife slapped her in the face repeatedly.

She said she tried to escape when she sought permission to go to her province but was not allowed to leave. She added Tan’s wife and Fayette even took nude photos of her.

“When they were not yet satisfied, they would hit me with steel or slippers, and threaten me that they would show my nude photos to other people or bring me to a nightclub owned by Ate Aleta's friend,” she alleged.

Sollano, who had been working for Tan's household for five years and two months, was rescued by operatives from the Quezon City Police District, CHR and DSWD last August 10.

The complainant was joined by lawyer Al Parreno in filing the complaint before the office of State Prosecutor Edna Valenzuela.

Submitted with the complaint were affidavits of representatives from police, Commission on Human Rights and Department of Social Welfare and Development and other persons present during the rescue.

Sollano's parents - fearing she was dead - only learned of their daughter's whereabouts from a fellow maid Aljane Bacanto, who escaped the Tan's household recently.

The father then sought the help of provincemates and private lawyers who then brought them to the CHR to seek assistance from authorities.

Where are the stories of how Lucio Tan's various sons from his many 'wives' escaped persecution by 'self-imposed exile' into another country for first degree murder, accidental death by negligence and illegal activities, carrying and brandishing illegal weapons? Maybe the media should dig into this rather than the less grave offense of 'abuse' because in our books, murder is a graver sin... than the fabricated stories of abuse.

CRIMINAL charges were filed yesterday before the Department of Justice (DOJ) against Lucio Tan’s brother Mariano Tanenglian, his wife Aleta and their two children based on the complaint of their 18-year-old housemaid, who was earlier rescued by police authorities from their residence.

The housemaid, Mary Jane Sollano, was accompanied by her lawyer Al Parreno to the DOJ in filing the complaint before the office of State Prosecutor Edna Valenzuela.

Attached to the complaint were affidavits of representatives of the police, Commission on Human Rights, Department of Social Welfare and Development, relatives of the victim and other individuals present when she was rescued from the Tanenglian’s residence on August 10, 2009.

In her sworn statement given to the National Police-Women’s and Children’s Complaint Desk, Sollano recounted her ordeals during her five-year stay at the Tanenglian residence on Dapitan corner Bato streets, barangay Siena, Quezon City.

Sollano said she suffered physical and mental abuse in the hands of her employers as she was prevented from using the telephone, her cellular phone, sitting on the sofas, eat at any time, laugh, read and write.

The complainant added that the Tanenglians would bang her head on the wall, kick her in the body and slap her whenever she made a mistake.

Because of the maltreatment, she asked the respondents to allow her to go home, but they refused, saying that she had to finish her two-year contract.

Before her service contract lapsed, Sollano said she was told to sign a document by Aleta without telling her what it was for. She, however, found out later that it was to extend her contract for two more years.

“In my five-year stay in their house, I was not allowed to go out. They even threatened me that they would do something bad if I ask for help from outside,” she claimed.

She even recalled an instance when she was brought by Aleta and her daughter Fayette inside a room to take nude photos of her.

Sollano’s parents admitted that they have lost contact with their daughter for almost five years, prompting them to think that she was already dead.

They added that they learned of her whereabouts only from a fellow maid, Aljane Bacanto, who managed to escape from the Tanenglian household recently.

Sollano was rescued last Monday by combined elements of the Commission on Human Rights (CHR), Department of Social Welfare and Development (DSWD) and the Quezon City police. The victim will pursue charges against her former employers for alleged illegal detention and abuses she suffered in the last five years.

Sollano, a native of Pagadian City, Zamboanga del Sur, is still recuperating from the trauma following her rescue from the Tanenglian residence at No. 30 Biak na Bato St., Sto. Domingo, Quezon City. She is set to undergo a battery of physical, emotional and psychological tests.

In a statement, Melanie Trinidad, legal counsel of the maid’s father, said Sollano will execute her sworn statement and complaint before police authorities.

Despite the waiver that Sollano, her father and her brothers were told to sign by Tanenglian’s lawyer as a condition for her release, the Sollanos are bent on filing charges to seek justice for the illegal detention and maltreatment she suffered.

Sollano, who was employed while still in her early teens at the Tanenglian household, allegedly suffered five years of physical, emotional and psychological abuse in the hands of Tanenglian’s wife, Aleta, and their two children.

The maid claimed that she was not allowed to leave the residence nor communicate with relatives and was often left with nothing to eat. She didn’t even know what date it was, the lawyer said.

Sollano’s parents, fearing she was dead, only learned of their daughter’s whereabouts from a fellow maid who escaped the Tanenglian household recently.

The father then sought the help of provincemates and private lawyers, who then brought them to the CHR to seek assistance from authorities.

Now if we are children, then we are heirs--heirs of God and co-heirs with Christ, if indeed we share in his sufferings in order that we may also share in his glory. I consider that our present sufferings are not worth comparing with the glory that will be revealed in us. The creation waits in eager expectation for the sons of God to be revealed (Romans 8:17-19).

MANILA - After incurring a $301.4-million loss at end-March, flag carrier Philippine Airlines (PAL) will take drastic measures of right-sizing its workforce and reducing flight capacity to match demand in order to survive the crisis plaguing the global aviation industry.

In a statement, PAL president and chief operating officer Jaime Bautista said the company will offer early retirement packages for its employees to reduce costs.

“We are currently reviewing our entire organizational set-up. We want to make PAL lean and mean so it will be agile and flexible enough to adapt to the new economic climate," he said, noting that "extraordinary times call for extraordinary measures."

At present, manpower accounts for 18% of PAL's total expenses and the company wants to reduce this to close to single-digit level, according to Bautista.

Bautista refused to say how many of PAL's over 8,000 employees will be retired, noting that they will be able to come up with a number in about 2 weeks.

Apart from cutting workforce, Bautista said PAL will also realign its capacity in favor of the domestic market due to the weakness in its long-haul operations, particularly to the US, where the financial crisis began.

He said they will cut total capacity by 7% starting this month until March 2010, effectively reducing flights to the US, Canada, Japan, Hong Kong and Australia.

For instance, he said flights to Los Angeles are now down to 7 from 9 a week while flights to Australia have been reduced to 5 from 7 a week.

But he stressed that such moves "will no way infringe on our safety compliance and standards."

MANILA - Police on Thursday warned people to be careful of who they hire as their household help, as authorities are on the hunt for the suspects in the murder of film critic Alexis Tioseco and Nika Bohinc.

Police are now conducting manhunt operations for Criselda German Dayag, 64 years old, one of Tioseco and Bohinc's maids, and 3 unidentified gunmen.

Another household helper, Magdalena Patpat, said Dayag let the 3 gunmen enter the couple's rented home at Times Street, West Triangle, Quezon City at around 10 pm Tuesday.

Patpat told police investigators that the gunmen hogtied and covered her mouth with a cloth while clearing the couple's home of valuables.

One of the gunmen shot the couple as they entered their home, police said.

However, Quezon City Police District (QCPD) Homicide Division chief C/Insp. Benjamin Elenzano said that they will include Patpat in their investigation.

Initial police investigation said Dayag has been employed by Tioseco and Bohinc for a little over a month, and was recommended by an acquaintance.

Police are now warning people to be careful in hiring household help. Elenzano said that people should scritinize the records of people applying as household help, and said it would be better for employers to hire people they know.

PAL's move seen as a 'deceitful scheme of massive layoffs'

MANILA - A labor group opposed the early retirement packages offered by flag carrier Philippine Airlines (PAL), which it branded as "a form of massive retrenchment."

According to militant labor center Kilusang Mayo Uno (KMU), PAL's early retirement scheme will cut regular employees from its workforce to hire contractuals, further boosting the airline's profits.

Contractual workers are deprived of benefits given to regular employees. They can also be fired more easily with little or no cost to the management, as compared to regular workers.

"We call on the PAL management to immediately stop offering early retirement packages to regular workers. While this scheme promises to give regular workers hefty retirement packages, it is still a form of massive retrenchment, and a deceitful one at that," KMU Chairperson Elmer Labog said in a statement.

Last month, PAL President and Chief Operating Officer Jaime Bautista said the company will offer early retirement packages for its more than 8,000 employees to reduce costs. Bautista said manpower accounts for 18% of PAL's total expenses, adding that the company wants to reduce this to close to single-digit level.

KMU, however, said that PAL's claim of losses is "highly questionable," given the increase in Lucio Tan's net worth to $1.7 billion from $1.5 billion as reported by Forbes Asia Magazine.

"We don't buy the lie that PAL is incurring losses, as its owner Lucio Tan has just firmed up his position as the second wealthiest man in the country today," Labog said.

Tan placed second in Forbes Asia magazine's list of the 40 richest people in the Philippines. Clinching the top spot is retail mogul Henry Sy, while Ayala conglomerate's Chairman Jaime Zobel de Ayala placed third in the list.

Talked to two PAL executives last week. Exactly same story as one retired PAL Captain I talked to 2 months ago, and a PAL Captain I talked to 3 weeks ago. All four sources are aligned.

1. PAL hedged on fuel when it was $100++ per barrel -- they bought a year's supply of Jet A-1 (actually they bought a "future contract" at a hedge price pegged to $120 per barrel of Saudi Light Crude). The numbers varied slightly from person to person, but you get the picture.

2. When the actual spot market price hit $120++, they got ecstatic on their foresight, and bought another 6 months (others said 3 months, but you get the picture)

3. Then the oil spot price dropped to $40++ per barrel. A catastrophe! PAL now is committed to buying all their fuel at a price that is 2-3 times higher than their competitors can buy on the spot market. FOR OVER ONE YEAR! That's a 200-300% higher price than spot! And fuel is by far the biggest cost item in airline operations.

4. The downgrading of the Philippines from Category 1 (acceptable) to Category 2 (shithole) means that no Philippine air carrier can expand routes, change routes or get new routes.

5. PAL is under contract (legally binding contract, mind you) to obtain a number of B777s (the number varies from source to source, some said 6, others 4). Half is to be leased, half to be bought from Boeing.

6. PAL has no use for these aircraft given #4 above -- they cannot open routes to Europe, the US or anywhere else. So they tried to cancel the orders for the B777s.

7. PAL was able to cancel half the orders (can't remember if they cancelled the leases or the purchases). But they are stuck with 2 or 4 aircraft that they have no use for. And this is on top of the price premium on fuel.

8. They have to use the airplanes on existing routes --underutilized assets, idle flight crews.

This is a purchasing issue -- but not really bad judgement. Cathay Pacific and Singapore Airlines also got caught on the wrong side of a fuel hedge. But they were better funded and can ride out the mistake.

An airline is a transportation company, not an airplane company. The best managers should be in Sourcing and Procurement and Marketing, because of the criticality of business volume and operating cost.

I've been writing here about the imminent demise of stupidly managed airline companies. The death of PAL (LT has already said it is very close to the brink, one person used the words "life support", at a dinner with senior executives and flight operations last week) would put hundreds of unemployed pilots on the job market.

Good luck to the pilots, and the would-be pilots waiting for jobs.

As I've said before, an airline company is a business. You mismanage it, you die. Just like any other business.
